Occupation Criteria for Local Needs Dwelling
1. The Occupation Criteria shall be deemed to be satisfied either by a person who:

(a) minimum continuous period of residence of five years in the Parish (or
Adjoining Parishes or the District as the case may be) immediately prior to the
intended disposal and is in need of a separate home, or
(b) employment in the Parish (or Adjoining Parishes or the District as the case
may be) for a continuous period of at least five years; or
(c) current employment in the Parish (or Adjoining Parishes or the District as
the case may be) in an agricultural related activity, the emergency services, as
a professional healthcare or social worker or as a qualified primary or secondary
school teacher; or
(d) strong established and continuous links with the Parish (or Adjoining
Parishes or the District or the adjacent administrative district as the case may
be) by reason of birth or family and in addition still having a parent or guardian
living there despite the person having moved away from the Parish; OR
B is a dependant, spouse or bona fide partner of such a person
2. Any person who occupies the Local Needs Dwelling under Paragraph 1B, but
who ceases to satisfy the Occupation Criteria on the death of the parent, spouse
or bona fide partner with whom they lived may continue to occupy the dwelling
as his or her sole residence. After a relationship breakdown, if the person was
qualified under Paragraph 1B, they may continue to occupy the dwelling as their
sole residence.

For the purposes of paragraph 1 A, a, of this Schedule, a person shall be
deemed to be in need of a separate home if he or she needs to set up a new
household as a result of divorce or separation or commencing co-habitation or
marriage, or as a result of leaving tied accommodation after retirement, or
whose present accommodation is sub-standard or unsuitable to their present
circumstances because of age, an impairment, medical condition or to meet the
needs of a growing family.
