Why?When asked in the last 12 months to re-let property for new landlords - 100% of cases were found not to have any, or all of the legal documentation required, in order to legally let the property - risking invalidating the tenancy agreement and forfeiting the landlords rights, with potentially £63,250 in finesand or a prison sentence! We want to keep you out of prison and keep your rights to end any tenancy and avoid big fines!
How?We will conduct a thorough check of all of the tenancy documentation including:The Tenancy Agreement itself, the EPC, Gas Safety Certificate, EICR, How to Rent Guide, Deposit Registration and Prescribed Information - all of which have been subject to legislation and other updates / changes in recent years.After we have checked through all of the above, we will:• List any or all items missing / incorrect / invalid (if at this point all is found to be ok, we will advise and issue a clean bill of health) and a reduction in the fee.• Advise on how to remedy the issues identified and we will then, depending on what level of service you require, either arrange, or put you in touch with local professionals.• Set automatic reminders for any renewal items so that we can alert you in the future when these items are due to expire.
Fines for individual missing prescribed tenancy documents• Invalid or no EPC present - up to £5,000 per property• Invalid or no Gas Safety Certificate -up to £6,000 per property and or a prison sentence• Invalid or missing EICR - up to £30,000 per property• Incorrect registration of deposit, non-issuing of prescribed information or deposit scheme terms and conditions - up to 3 times the value of the deposit. £2,250 per tenancy based on theaverage rent of £650pcm with a 5 week deposit of £750.• Invalid or incomplete Right to Rent Check - up to £10,000 per occupier (up to £20,000 if repeated)
Example total of £63,250 in fines based on a couple renting a property with none of the above in place, along with the potential of a prison sentence totalling on average of about 6 months! (according to various online sources)
